Eligibility, Payment (Salary), and Tenure of the Governor of an Indian State, as per the Constitution of India and official provisions:


1. Eligibility (Qualifications) for Governor

Mentioned under Article 157 & 158 of the Constitution.

A. Constitutional Qualifications

A person must:

  1. Be a citizen of India
  2. Be at least 35 years of age
  3. Not hold any office of profit
    (Unless he/she resigns before assuming office)

B. Additional Constitutional Conditions

  • The Governor must not be a member of Parliament or any State Legislature
    (If selected, the person must resign before taking oath)
  • The Governor should not hold any position giving financial benefit from the government.

C. Other Considerations (Convention-based)

Not written in Constitution but usually followed:

  • Should be a person of good public standing
  • Should not belong to the state where he/she is appointed (for neutrality)
  • Generally senior politicians, retired civil servants, judges, academicians, etc., are appointed

2. Payment (Salary & Allowances) of Governor

As per the Governor’s Emoluments, Allowances & Privileges Act.

Current Salary (as revised)

  • ₹3,50,000 per month (Basic Salary)

  • Official residence (Raj Bhavan)
  • Staff & household allowances
  • Medical facilities
  • Conveyance / Car with driver
  • Free accommodation & utilities
  • Security (Prime/Category Z in many states)
  • Travel allowances for official duties
  • Pension after completing term (if eligible)

✓ No income tax on salary (as per constitutional provision).


3. Tenure of Governor

As per Article 156:

A. Term

  • 5 years (standard tenure)

B. At the Pleasure of the President

  • The Governor can be removed earlier by the President at any time
    (No grounds required, political decision)

C. Hold Office Until Successor Takes Charge

  • Even after 5 years, the Governor continues until the next Governor joins.

D. Reappointment

  • A Governor can be reappointed for another term
  • Can also be transferred to another state
